C' Forms

The Basic Central Sales Tax Rate as applicable to the Interstate transactions made by the Registered Dealers is 2%. The interstate transactions are charged at this rate, if the purchasing dealer issues the Statutory Form –  Form C  to the selling dealer. The selling dealer submits this  Form C  with his sales tax authorities for payment of  2%  and the forms are supplied by the Department on an application by the Registered dealers.  Also the interstate sales are exempted from CST, if such sales are made to specified persons or organisations, on submission of Forms like  Form H ,  I ,  J  etc,

Different between Society and Societies.

A society is essentially an association of 10 or more people. Where there is legislation to provide for registration of specific types of association of persons (e.g. by the nature of their objects), these associations will be excluded from the definition of “society”. Hence, a “society” can include any club, company, partnership, whatever its nature or object, but does not include any company registered under the Companies Act, trade union, co-operative society or mutual benefit organization.Members of a co-operative society get together to promote the economic interest of their members. They have to submit viable business plan of the co-operative before registration. These two pre-requisites are not present in a society.

Cr.P.C.202

In the case of Adalat Prasad v. Rooplal Jindal 2004 (4) Mah LJ 274 : (2004 Cri LJ 4874) the Apex Court has held that "a condition precedent for issuing process under Section 204 of the Code of Criminal Procedure is the satisfaction of the Magistrate either by examination of the complainant and the witnesses or by the inquiry contemplated under Section 202 of the Code of Criminal Procedure that there is sufficient ground for proceeding with the complaint hence process is issued under Section 204 of the Code. In none of these stages the Code has provided for hearing the summoned accused, for obvious reasons because this is only a preliminary stage and the stage of hearing of the accused would only arise at a subsequent stage provided for in the latter provisions of the Code. Therefore, the question of the accused on receipt of summons approaching the Court and making an application for dismissal of the complaint under Section 203 of the Code for a reconsideration of the material av

Sage Astaavakra Story

Jai Sri mannarayana,   Sage Ashtavakra was one of the greatest sages of ancient    India   and had composed the famous Ashtavakra Gita. The story of Ashtavakra is very interesting. His parents were Sage Khagodara and Sujata. It is said when Ashtavakra was in womb of Sujata, he criticized his father for wrongly chanting the Vedas. Ashtavakra used to listen to Vedas when he was in womb. He learned it and once suggested to his father that he was chanting a mantra wrongly and the sounds created by each syllable matters. Sage Khagodara got angry and cursed the baby to be born crooked and with curves. The sage out of ignorance believed that the baby was being arrogant. Sage Khagodara was very poor and once he went to take part in a debate in the court of Janaka hoping to win some prize. There he got into a debate with Vandina, a scholar in the court. The deal was that one who lost in the debate will perform Jal Samadhi, die by jumping into river. Sage Khagodara lost th

ANTI LAND GRABBING SPECIAL CELLS During 2006–2011, there were a large  number of cases of land grabbing and forcible sales in the State. Though complaints were made to the police in the last 5 years no action was taken by the police.  As the number of complaints increased manifold since the assumption of this Government, I ordered the formation of special cells to investigate such cases. Consequent to my announcement that  appropriate action will be taken against the persons  who wrongfully dispossessed the properties of the rightful owners by intimidation and force during the previous regime and that the properties will be restored to the rightful owners, the number of complaints  received with regard to land grabbing grew to 8,947 as on 17.08.2011. This Government has sanctioned the formation of 36 Anti Land Grabbing Special Cells in 8 Tamil Nadu with one cell each at the State Police Headquarters, 7 Commissionerates and 28 Districts except Karur, Tiruvannamalai and Nagappattinam Di

No builder executes an agreement with a flat buyer for sale of open parking space, as he knows it is illegal. What the builder normally does is he gives an allotment letter and takes money against this. In fact the problem can be tackled if builders are compelled to follow the model flat purchase agreement where clause 2 of the model agreement makes it clear that the price paid by the flat purchaser includes not only the price of the flat but also areas and facilities like staircase, passage, open parking space etc. Hence when the buyer has paid for the built up area, and is again paying for the parking space, he is in fact making a double payment.

i) A separation of one year before filing the case please note that actual physical separation is not required, even if both parties are sleeping in the same bedroom they can be said to be seperated for the purposes of mutual consent, if they are not living together as husband and wife; ii) A flawlessly drafted MoU (Memorandum of Understanding) that settles the terms on which you part away, people don’t understand the importance of this, this is extremely important so as to end the matters with a finality once and for all, there are no loose ends and make sure there is no litigation in future; Once the above is done – you have to get drafted the Divorce petition that encapsulates the contents of your earlier MoU. After Court When you file your divorce by mutual consent petition – it comes up for hearing and your statements are recorded, then the court gives you a period of 6 months (basically to think over your decision) after which,  on recording of final statements

To calculate this actual gain, the Income Tax department releases a cost-inflation-index (CII) figure every year. Usually, in May, it will release the CII for the last financial year - so the CII for 2010-11 will be released in May 2011. And it's not easy to find; but luckily enough people get to know. Effectively, the cost of acquisition becomes substantially lower. The formula is: Indexed Cost of Acquisition = (Actual cost of purchase) * (CII Of Year of Sale)/(CII of Year of Purchase). Capital Gain = (Sale Price MINUS Indexed Cost of Acquisition). Capital Gains Tax = 20% of Capital Gain For example, if you bought 1000 units of a debt fund at Rs. 50 per unit in 2008-09 and sold the 1000 units in 2009-10 for Rs. 55, then: (Purchase Price = Rs. 50,000 and Sale price = 55x1000 = Rs. 55,000) a) Indexed Cost of Acquisition = 50,000 x (632/582) = 54,295. b) Capital gain = 55,000-54,295 = 705. c) Capital Gains tax = 20% of 705 = Rs. 141. The indexation benefit allo
